Decisions made in proceedings in the trade mark registry against
one party did not constitute a cause of action or issue estoppel
in a subsequent legal proceedings in the High Court since the
decisions of the trade mark registry were not final against the
party who had lost in those proceedings. Therefore, it was not an
abuse of process for the party who had lost in the trade mark
registry to raise similar issue in the subsequent High Court
proceedings between the same parties.
