Although in the majority of cases where the conditions for the application of s 339 of the Insolvency Act 1986 were satisfied (where a bankrupt had entered into a transaction at an undervalue), the court would make an order, the court retained an overall discretion which was wide enough to enable it to make no order at all where, exceptionally, justice so required, and that was not limited to extra-territorial considerations.
