The bringing in a member state of an action against a defendant
domiciled in another member state, pursuant to art 6(1) of
Regulation 44/2001 on jurisdiction and the recognition and
enforcement of judgments in civil and commercial matters, was not
precluded by the fact that proceedings against the defendant in
the first state were barred under a law of that state.
