An employers pension handbook stated that retirement at 62
without penalty was available in certain circumstances subject to
small print exclusions about the consent of the pension fund
trustees.  The Pension Ombudsman said the exclusions were not
effective and could not be relied on.  The Court of Appeal
disagreed saying that the small print was unambiguous and was
binding on the employee.
