In 1999 the claimant pleaded guilty to the manslaughter of her husband, a retired police officer in receipt of a pension under a scheme governed by the Police Pensions Regulations 1987. She was refused a share of his pension and appealed without success. The Police Pensions Act 1976 and Regulations made thereunder were not intended to displace, but to operate alongside, the common law rule of forfeiture, and the provision for forfeiture in regulation K5 of the Police Pensions Regulations 1987 conferred a further limited discretion on police authorities to withdraw pension entitlement in the circumstances defined.
