S 32(6) of the Criminal Justice Act 1991 was to be construed as
giving the Secretary of State power to provide guidance to the
Parole Board as to matters to be taken into account in order to
assist the board to reach a structured decision on the question
which was its duty to decide. So construed the power did not
impugn the independence of the board and could properly apply
both to its judicial and other functions of the board.
