The Act establishes the new court with a new jurisdiction to deal
with decision-making for adults who lack capacity. This court will
have important structural differences from the current Court of
Protection and will begin operating from April 2007. The new
court will be able to make decisions about personal welfare
matters including health care, as well as property and financial
affairs. This means that cases will be dealt with more easily and
effectively by a dedicated court. Currently decisions on welfare
matters are dealt with by the High Court.
