The main principle when calculating damages in lieu of an
injunction to prevent an infringement of a right to light, at the
point just before any infringement took place, was that the court
had to attempt to find what would be a fair result of a
hypothetical negotiation between the parties, and should consider
whether the result ‘felt right’.
