The distribution of a signal by means of television sets by a
hotel to customers staying in its rooms constituted a
“communication to the public” over which authors had copyright
control by virtue of art 3(1) of European Parliament and Council
Directive 2001/29/EC, though the mere provision of the physical
facilities did not itself amount to “communication”.
