The Court of Appeal had a residual jurisdiction to review on
appeal the misconduct or unfairness of a judge’s determination
concerning the grant or refusal of permission to appeal,
following a decision on an appeal from an arbitral tribunal. It
was not enough to show that the decision was perverse. There had
to be such a substantial defect in the fairness of the process as
to invalidate the decision. It was likely to be an exceptionally
rare case where the submission of unfairness was justifiably
advanced.
