Tribunal refused claim by respondent to ex discrimination claim to
be allowed to participate in remedies hearing because the response
was late.  The EAT remitted the matter for a re-hearing because
the decision prejudiced the respondent whee no prejudice would
have been suffered by the claimant if the matter had proceeded and
so was against the interests of justice.
