Court's Powers Of Own Motion

Court Granting Extension Of Own Motion
Keen Phillips (A firm) v Field
CA
26 October 2006
Daily Law Notes Summary
Where a party seeking permission to appeal in the county court
had breached a case management order as to the filing of a
transcript of the judgment under appeal, and a sanction
ostensibly applied, the judge hearing the application for
permission was entitled to extend time despite the applicant’s
failure during the hearing to make an explicit application for
such an extension.
