restriction on competition would be entitled to claim damages
against the perpetrator of the restriction, just that no-one had
ever succeeded in such a claim. In Inntrepreneur Pub Co v Crehan
[2006] UKHL 38 the House of Lords reversed the decision of the
Court of Appeal ([2004] EWCA Civ 637), which had awarded damages
to the tenant of a public house who had seen his business fail
(he contended) because the terms of his lease obliged him to pay
over the odds for beer: so it is still true to say that no-one
has succeeded in such a claim.
