Change Non-Competition Clauses, But Do It Right

Unfair Dismissal for Refusing to Accept New
Non-Competition Clauses
Willow Oak Developments Ltd (trading as Windsor Recruitment) v
Silverwood: [2006] EWCA Civ 660
CA
25 May 2006
Daily Law Notes Summary
New widely drawn covenants restricting their business activities
after their employment ended were imposed on employees who were
dismissed for refusing to accept them.  The CA held that this
might have been justification for dismissal and was only unfair
because the employers had failed to introduce the new rules in a
reasonable manner.
